Let’s go the limit

Two penalties at the total rate of USD77 million in one day - this is a new record of one of the largest banks in the UK. Barclays was fined both by British and American regulators at once. The U.S. Securities and Exchange Commission was paid in the amount of USD15 million for “ineffectiveness of bringing internal regulations in accordance with the law about financial consultants.” Examining officials managed to disclose some offenses in work of one of the banking group’s companies. During the investigation it was found out that Barclays conducted over 1,5 thousand transactions without obtaining the written consent of customers and demanding illegal payments of fees for these operations. The amount overpaid came at in USD 472 thousand and the actual profit totaled USD3,1 million. The rest amount of penalties remained in the UK. The British Financial Conduct Authority in contrast to their American colleagues decided to think big. For insufficient measures aimed at security of the deposited clients’ assets, the bank was fined by USD62 million. It should be noted that over the Authority’s history it was the largest penalty for similar offenses which were observed during the period from November, 2007 to January, 2012. Thus, Barclays got a so-called discount of 30 percent from the original amount of penalty for having admitted guilt at early stages of investigation. This case is not a single one. In 2011, a bank paid GBP1,1 million for such offenses but this time the penalty amount is considerably larger. “Barclays can pay back up to GBP900 to resolve various claims of British and American regulators related to possible bank’s participation in manipulation of the currency market and deception of clients in dark pool," an analyst at Sanford C. Bernstein Ltd. Chirantan Barua considers. Additionally, the bank reserved over GBP1,6 billion as compensation to customers who lost money on swaps as well as to clients who were forced to buy unnecessary insurance. Hence, the bank is ready for penalties and bans!
