
Indian IT-company Infosys was carried before justice as it was accused of discriminating U.S. citizens, according to Arstechnica. The lawsuit was prompted by the incident when one of the employees was termed as “a stupid American” after he had asked a question about a nationality and citizenship of the staff.
According to the claim’s data, Infosys has 15 thousand U.S. employees, 90% of which comprise immigrants or citizens from South Asia (India, Nepal, and Bangladesh). Infosys was also charged with abuse of the right to take on foreigners under H-1B visa system which concerns skilled professionals.
The suit was filed to the East Wisconsin county court by Brenda Keller, an IT specialist. In April 2012, she made an attempt to apply for a sysadmin vacancy but she was denied.
The suit asserts that the company rejected her application allegedly due to the lack of experience that was wrong. Eventually, the vacancy was filled with an applicant from Bangladesh.
Keller states that her lawsuit is lodged on behalf of thousands of Americans who have been unable to get jobs owing to the discrimination by South Asian immigrants since January 2009. In the claim against Infosys, the company is requested to change its human resources policy for non-discriminative.
Keller referred to the words of Jay Palmer, an ex-employee who discovered in 2008 that his Indian colleague had written on a board: Americans are worth money, no Americans/Christians. After he had submitted an appropriate complaint addressed to the boss he accepted lots of insulting and threatening phone calls. In particular, somebody was telling: “Why are you doing this, dummy American? We were treating you well. Piss off! You are not wanted here. Hope you will drop dead on the way back, thick-sculled American.”
So Palmer’s complaint was disregarded by Infosys’ management, then he brought the case before the court. However, a circuit judge did not find elements of the offense in the company’s conduct, although he admitted that the telephone threats “caused concern.”
Last year during the Senate hearings, Senator Dick Durbin stated that Infosys and other IT-companies are always abusing the right in arranging H1-B visas in order to help their former or present day compatriots. In particular, this is done to bring down company’s outgoings since South Asian employees come at a lower cost.
Infosys Technologies is a company dealing with software development for e-business and telecom firms. Its annual business volume exceeds $7 billion. The company was founded in 1981 in the Indian city Bangalore.
