Musk Files New Lawsuit Against OpenAI, Sam Altman

Elon Musk has recently initiated a new lawsuit against OpenAI and its co-founders, Sam Altman and Greg Brockman, only a few months after dismissing a similar case against the organization behind ChatGPT.

Musk contends that the company's focus on profit-driven artificial intelligence development has eclipsed the potential benefits for humanity.

His attorney, Marc Toberoff, mentioned that this lawsuit is more assertive than the previous one. The case, filed in California, delineates Musk's disagreements with Altman and others as a conflict between altruism and greed.

Musk, who co-founded OpenAI in 2015 but subsequently resigned from its board due to differing views on its direction, claims that since his departure, OpenAI has emerged as a leader in generative AI. Concurrently, Musk founded a competing startup, xAI, which was valued at $24 billion in May.

In this latest lawsuit, Musk seeks a court ruling to nullify OpenAI's licensing agreement with Microsoft, arguing that the language models exceed the parameters of their collaboration. He requests a jury trial, damages to be determined during the trial, and either a complete or partial invalidation of OpenAI's licensing deal with Microsoft. Furthermore, he demands damages based on "an accounting of all gains, profits, and advantages" that OpenAI gained from his contributions. A favorable ruling for Musk could jeopardize the profitable partnership between OpenAI and Microsoft, given that Microsoft has invested $13 billion in the startup in exchange for AI technology integrated into its services.

OpenAI has not commented on the new lawsuit, but in March, they refuted Musk's claims by releasing emails suggesting that Musk had endorsed plans to establish a for-profit entity and a merger that would transform it into Tesla's "cash cow." OpenAI had previously dismissed Musk's earlier claims as "incoherent and frivolous" and published a blog post featuring several of Musk's emails from the company's early days, indicating his acknowledgment of the need for significant funding to support the computing resources required for AI model development.
